Workseekers Agreement

1. DEFINITIONS
In these terms of business the following definitions apply:

Candidate: The Workseeker introduced by Tier One Recruitment to the Client for an Engagement including any officer or employee of the Candidate if the Candidate is a limited company

Tier One Recruitment: The trading name of the employment agency the candidate has agreed to represent them, which is owned by Alexandra Gavin and to which all fees by the Client are payable and terms agreed.

Appointment: The engagement of a chosen Candidate by the Client or any engagement of a Candidate with a subsidiary or associated company, or third party, resulting from a referral by the Client. An Appointment includes any employment or use of the Candidate by the Client whether under employment status, a contract for services or under any agency, licence, franchise or partnership agreement.

2. GENERAL
By signing this agreement the Workseeker is confirming that:
* As a Candidate all information given to Tier One recruitment including: experience, training, qualifications and work visa (according to the United Kingdom statutory laws) is correct.
* As a Candidate you are not in breach of (a) the Asylum and Immigration Act 1996, any rules or regulations made pursuant to the act or any other act rule or regulation;
(b) any statutory common law or contractual obligations to any third party;
* As a Candidate you have no unspent convictions within the meaning of the Rehabilitation of Offenders Act 1974.

As Tier One Recruitment we will represent you on these grounds.

3. CONTRACT
This Agreement contains the terms on which the Workseeker will be introduced to a Client by Tier One Recruitment.

For the avoidance of uncertainty, this Agreement shall not give rise to a contract of employment between Tier One Recruitment and the Workseeker.

No variation or alteration of these Terms shall be valid unless approved by a Director of the Consultant in writing.

The Candidate will also be liable to any legal action and associated costs resulting from a breach of confidentiality.

4. CONFIDENTIALITY
The Candidate agrees to protect the confidentiality and trade secrets of the Client and Tier One Recruitment and without prejudice to keep secret all Information given to the Candidate or gained in confidence.

5. LIABILITY
Tier One Recruitment shall not be liable for any loss or damage or expense suffered or incurred by the Candidate arising from or in any way connected to the Client wishing to make an Appointment.

6. LAW
These Terms are governed by the law of England & Wales and are subject to the exclusive jurisdiction of the Courts of England & Wales.
